Assam: Gauhati HC grants bail to IIT student accused of rape, calls him "state's future asset"

After hearing the accused’s bail application, the single-judge bench of Justice Ajit Borthakur, in its August 13, 2021 judgement, said that there is a "clear prima facie case as alleged against the petitioner based on all the evidence".

The Gauhati High Court recently granted bail to a student of the Indian Institute of Technology (IIT), Guwahati, for allegedly raping a fellow student and termed both the accused and the survivor as "state's future assets".

After hearing the accused’s bail application, the single-judge bench of Justice Ajit Borthakur, in its August 13, 2021 judgement, said that there is a "clear prima facie case as alleged against the petitioner based on all the evidence". The judge, however, noted that the investigation in the case has been completed.

The court added that both the victim and the accused are the "state's future assets", as both the students are young, talented and are pursuing technical courses at the IIT-Guwahati. After "a perusal of the list of witnesses", the court found "no possibility of the accused tampering with their evidence or influencing them directly or indirectly, if released on bail," he added.

On March 28, 2021, the 21-year-old BTech student was arrested for "sexually assaulting" his peer, a 19-year-old student of the same department, on the IIT-Guwahati campus.

The high court granted bail to the accused for Rs 30,000 bond and two sureties on the condition that he continues to appear before the court till the case is disposed of.
