Supreme Court rejects plea for release of detained Rohingya migrants

The Supreme Court, on April 8, rejected a plea seeking the release of detained Rohingya refugees in Jammu and Kashmir. 

The Union Government is likely to deport them to Myanmar following the procedures prescribed under the laws. 

“It is also true that the rights guaranteed under Articles 14 and 21 are available to all persons who may or may not be (Indian) citizens. But the right not to be deported is ancillary or concomitant to the right to reside or settle in any part of the territory of India guaranteed under Article 19 (1) (e),” the Court said.

Earlier, two Rohingya refugees from Delhi had moved the Supreme Court seeking release on grounds that they would face “a threat to life and limb if deported.”  

The Centre told the court that they were illegal migrants and India cannot be turned into a “capital of illegal migrants.”
