Need not restrict 7 MLAs from attending Nagaland Assembly session: Gauhati HC

KOHIMA: The Gauhati High court Kohima bench chaired by Hon’ble Justice Songkhupchung Serto gave his judgement on the Interlocutory Application (IA) (11) filed by the opposition party the Naga People’s Front for restraining the seven rebel MLAs from attending the forthcoming Assembly Session.

The order stated that at this point there was no need to restrict the seven MLAs from attending the Assembly session.

The hearing of the two Interlocutory Applications filed by the petitioners and the respondents, IA (11) and IA (102) respectively, had concluded on February 9.

“The honourable High Court said that at this point there is no need of a restraining order for the seven MLAs from entering the forthcoming assembly because what I have found from the order, the matter (writ petition) will be disposed off within a week after the pleadings are completed,” NPF advocate Siddharth Borgohain told reporters after the order was issued.

The IA filed by the dissident MLAs challenging the “maintainability of the writ petition” filed by the NPF, was also rejected by the honourable high court.

Informing this, Advocate Borgohain said, “The honourable court after hearing the parties found the IA filed by the respondents is not maintainable because the petitioners made out a case where the perversity of the judgement passed by the speaker was questioned and this will be looked up by the High court in the writ petition itself, so the IA was devoid of its merits.”

The next hearing of the writ petition is listed for hearing next week.
