PIL moved against ‘fake’ encounters in Assam

The petitioner sought an independent enquiry and asked the probe to be complying with Supreme Court guidelines. The petitioner also prayed for a judicial probe by a sitting judge of the high court.

GUWAHATI:

A Delhi-based lawyer Arif Jwadder had moved the Gauhati High Court by filing public interest litigation (PIL) seeking an independent probe into the alleged encounters by state police in the last six months.

As many as 28 people were killed and more than 48 have been injured in a series of encounters by Assam Police in which the police blamed the accused of fleeing their custody.

In his petition (No 86 of 2021), Jwadder alleged that 80 such encounters have been reported since the new government took charge in May this year.

The petitioner sought an independent enquiry and asked the probe to be complying with Supreme Court guidelines. The petitioner also prayed for a judicial probe by a sitting judge of the high court.

He also sought monetary compensation to the families of those who died in the alleged encounters.

Earlier, the National Human Rights Commission (NHRC) had also sought for an action taken report from the state police in September, 2021.
